Terms of Service
These Terms of Service ("Terms") govern your use of the Groupmail 7 desktop application (the "app"), the website at groupmail7.com (the "Site"), and related services, provided by Groupmail Ltd ("Groupmail", "we", "us"), a company established in Ireland. By downloading, installing, or using them, you agree to these Terms. If you do not agree, do not use them.
1. The Services
Groupmail 7 is desktop email-campaign software for macOS and Windows. You use it to organise contacts, compose messages, and send email campaigns through a sending method you choose and control — including your own Gmail account, your own Microsoft account, or your own SMTP/relay provider. Your campaign data is stored locally on your device.
2. Preview releases
Groupmail 7 may be provided to you as a preview or pre-release version ahead of general availability. Preview software may contain errors and may change. Test your campaigns and keep your own backups before relying on a preview build for important sending, and expect features to evolve before launch.
3. Your licence
Subject to these Terms and payment of any applicable fees, we grant you a perpetual, non-exclusive, non-transferable licence to install and use the app on up to three machines you own or control. The app and Site are protected by intellectual-property laws; except for the rights expressly granted, we reserve all rights. You may not resell, sublicense, or redistribute the app, or reverse engineer it except to the extent the law allows.
4. Your data
You retain all rights to the contacts, message content, and other data you put into the app ("Your Content"). Because the app is desktop software, Your Content is stored on your own device, and you are responsible for it, including keeping your own backups. We do not receive a copy of Your Content in the ordinary course of your use of the app.
5. Sending accounts and third-party providers
You choose the provider you send through. If you connect a third-party service such as Gmail or Microsoft, you must comply with that provider's terms and rules, including their bulk-sending and acceptable-use policies and any sending limits. Groupmail 7 sends from your own account using the access you grant; our use of Gmail access is send-only and is described in our Privacy Policy. You are responsible for keeping your sending-account credentials secure. We are not responsible if a provider rate-limits, suspends, or terminates your account.
6. Acceptable use — the email you send
You are solely responsible for the campaigns you send and the people you send them to. You agree that you:
- have the necessary consent or lawful basis to email each recipient, and will honour unsubscribe and opt-out requests promptly;
- will comply with all applicable anti-spam and data-protection laws (including, where they apply to you, GDPR, the ePrivacy rules, CAN-SPAM, and CASL) and with your sending provider's rules and limits;
- will not use the Services to send unlawful, deceptive, infringing, harassing, or malicious content, or unsolicited bulk email (spam).
7. No guaranteed delivery
Email delivery depends on the sending providers, receiving mail servers, and recipients you choose — all outside our control. We do not guarantee that any message will be delivered, will reach the inbox rather than a spam folder, or will arrive within any particular time.
8. Disclaimers
The Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted or error-free. Nothing in these Terms excludes or limits any rights you have under mandatory consumer-protection law that cannot lawfully be excluded.
9. Limitation of liability
To the fullest extent permitted by law, Groupmail will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the Services will not exceed the amount you paid for your licence in the twelve months before the claim arose. Nothing in these Terms limits liability that cannot lawfully be limited.
10. Indemnity
You agree to indemnify and hold Groupmail harmless from claims, losses, and expenses arising out of the campaigns you send, Your Content, or your breach of these Terms or of any sending provider's policies.
11. Termination
You may stop using the Services at any time. We may suspend or terminate the services we directly operate (such as the Site and the licensing service) where required by law or where you breach these Terms. Your installed app continues to function under a valid local licence.
12. Governing law
These Terms are governed by the laws of Ireland, and the courts of Ireland have jurisdiction over any dispute arising from them, without affecting any mandatory consumer rights you have in your country of residence.
13. Changes to these Terms
We may update these Terms and will post the new version here with a new "Last updated" date. Material changes will be notified as required by law.
